Rajasthan Dead Body Act
- Official Name: Rajasthan Dead Body Respect Bill 2023.
- Passage & Enactment:
- Passed on July 20, 2023.
- Received Governor's assent on August 17, 2023.
- Notified on August 18, 2023.
- Significance: Rajasthan is the first state in India to implement such a law regarding the respect of deceased bodies.
- Key Provisions:
- Failure to Take Custody: If family members fail to take custody of a deceased's body, they may face up to one year imprisonment, a fine, or both.
- Protesting with Dead Body (by Family): Using a dead body for protest on the road by family members can lead to imprisonment from six months to two years and/or a fine.
- Protesting with Dead Body (by Others): If individuals other than family use a dead body for protest, they can face imprisonment from six months to five years and/or a fine.
- Leaking Genetic Data: Employees or officers found leaking genetic data of unclaimed bodies face imprisonment of 3 to 10 years.
- Mandatory Last Rites: Following a magistrate's order, if family members do not perform the last rites within 24 hours, the police are authorized to do so.
